Welcome to Witchy Lashes. These Terms of Service ("Terms") govern your use of witchylashes.com.au (the "Site") and any purchase you make from it. The Site is operated by Bravemark Pty Ltd trading as Witchy Lashes (ABN 16 700 285 721) ("Witchy Lashes", "we", "us", "our").

By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

1. Your Australian Consumer Law rights come first

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Everything else in these Terms is subject to this section.

2. Who can use the Site

You must be at least 18 years old, or using the Site with the involvement of a parent or guardian, to place an order. By ordering, you confirm the information you provide is accurate and that you are authorised to use the chosen payment method.

3. Products

We sell magnetic false eyelashes, magnetic eyeliner, applicators and botanical skincare. Our products are cosmetic products for external use. Please read the product description and instructions before use, and follow them. If you have known sensitivities or allergies, review the listed ingredients before purchase and discontinue use if irritation occurs. Product images are as accurate as we can make them, but colours and appearance may vary slightly depending on your screen.

If you have a medical procedure such as an MRI scheduled, tell your provider you use magnetic lashes and remove them beforehand.

4. Orders and payment

All prices are in Australian dollars (AUD) unless the Site displays your local currency, and include GST where applicable. Shipping costs are shown at checkout before you pay. When you place an order you make an offer to purchase; we accept it when we send your order confirmation. We may decline or cancel an order where we reasonably suspect fraud, where a product is unavailable, or where there has been an obvious pricing or listing error — if payment has been taken in these cases, we will refund it in full.

Payment is processed securely by Shopify Payments and its payment partners. We do not see or store your full card details.

5. Shipping and delivery

We ship from Australia. Delivery destinations, timeframes, costs and free-shipping thresholds are set out in our Shipping Policy, which forms part of these Terms. Delivery estimates are estimates, not guarantees — carriers occasionally have delays outside our control. All orders include tracking. Risk in the products passes to you on delivery. For international orders, you are responsible for any customs duties or import taxes charged by your country.

6. Returns, replacements and refunds

Our Refund Policy forms part of these Terms. In summary: any unopened item can be returned within 30 days of delivery for a full refund with no restocking or processing fees. Because lashes are a personal-use hygiene product, opened lashes can't be refunded, but if they don't suit your eye shape we'll exchange them for a style that does or give you store credit for the full amount within the same 30 days. Damaged or faulty items are replaced free of charge (or refunded if you prefer).

This policy operates alongside — never instead of — your Australian Consumer Law rights described in section 1. If a product has a major failure you may choose a refund or replacement, and these rights are not limited to any timeframe stated in our Refund Policy.

7. Promotions and discount codes

Discount codes and promotions apply only within their stated terms and dates, cannot usually be combined unless we say otherwise, and have no cash value. We may withdraw or amend a promotion where reasonably necessary (for example, in the case of error or abuse), but this will not affect orders already placed.

8. Your account and information

You are responsible for keeping your account details and password confidential and for the accuracy of the information you provide (including your shipping address — we can't be responsible for parcels sent to an incorrectly supplied address, though we'll always try to help). Our handling of your personal information is described in our Privacy Policy.

9. Reviews and content you submit

If you submit reviews, comments, photos or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce and display that content in connection with our store and marketing. You confirm the content is yours, is accurate, and doesn't infringe anyone else's rights. We may decline to publish or may remove content that is unlawful, offensive, misleading or infringing. You can ask us to remove your submitted content at any time by emailing us. We use customer stories and photos in marketing only with specific consent.

10. Acceptable use

You must not use the Site for any unlawful purpose; attempt to interfere with its security or operation; upload malicious code; scrape or copy the Site's content for commercial purposes without permission; or harass, abuse or harm others. We may suspend or terminate access for breach of this section.

11. Intellectual property

All content on the Site — including the Witchy Lashes name, logo, product names, images, copy, quiz content and design — is owned by or licensed to Bravemark Pty Ltd and protected by intellectual property laws. You may not reproduce, distribute or exploit any part of it for commercial purposes without our written permission.

12. Third-party tools and links

The Site may include tools, embeds and links to third-party websites and services (for example payment providers, review platforms and social media). These are provided "as is" for your convenience; we don't control them and aren't responsible for their content or practices. Your use of them may be subject to their own terms.

13. Accuracy of information

We work to keep the Site's information accurate and current, but occasionally content may contain typographical errors or omissions (including in pricing or availability). We may correct errors and update or cancel affected orders as described in section 4. General information on the Site (including blog articles) is provided for general purposes only and isn't professional or medical advice.

14. Liability

To the extent permitted by law, and subject always to section 1: we are not liable for indirect or consequential loss arising from your use of the Site; and our total liability in connection with any order is limited, at our election, to replacing the relevant products or refunding the amount you paid for them. Nothing in this section limits your rights under the Australian Consumer Law or our liability for fraud, or for death or personal injury caused by our negligence.

15. Indemnity

You indemnify us against loss arising from your breach of these Terms or misuse of the Site, except to the extent we caused the loss.

16. General

If any part of these Terms is found invalid, the rest remain in force. Our failure to enforce a provision isn't a waiver of it. These Terms, together with the Privacy Policy, Shipping Policy and Refund Policy, are the entire agreement between us regarding the Site. We may update these Terms from time to time by posting the revised version on this page with an updated date; changes apply to orders placed after they're posted. We may assign our rights under these Terms in connection with a sale or restructure of the business; you may not assign yours without our consent.

17. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales. If you're a consumer outside Australia, this doesn't deprive you of any protection you have under the mandatory laws of your own country.
